attempt to get out of the way

Fed rules.
Does the batter have to make some kind of attempt to get out of the way of an inside pitch? Batter didn't even flinch at all on a slow inside fast ball and was HBP and awarded first. Seems like this rule has been fairly inconsistent this season with some guys awarding a base and others saying the batter has to attempt to get out of the way - but what's the rule?

7-3-4 says that the batter shall not "permit a pitched ball to touch him."
8-1-2d says that he's awarded first unless "he makes no effort to avoid being hit."
So, there's some discrepancy in the rules, and interpretation of "permit" and "no effort" is required.
In general, a flich is an effort. If the ball is so far inside that even an effort would be futile, then first will be awarded.
And, different umpires will judge it differently.
