Starting with the 2009 season NLYBS will implement background checks for Board members, coaches and umpires over 18

NLYBS Background Checking Policy

Policy Details

   1. Guiding Principles
         1. Background checks are used to support the NLYBS's priority to create a safe and secure environment for its participants, families, volunteers, and visitors.
         2. The background check process is intended to assist the NLYBS in the evaluation of whether a volunteer is suitable for the position.
         3. The NLYBS desires to promote fair and consistent methods to obtain, analyze and retain information on volunteers' background checks.
   2. Regulations
         1. The NLYBS Board may contract with a third party to provide background checks.
         2. Background checks must be preformed on all volunteers filling or seeking to fulfill the following positions.
               1. All Board Member positions
               2. Coach
               3. Assistant Coach
               4. Umpires over the age of 18
               5. Others at the discretion of the NLYBS Board
         3. All persons undergoing a background check must be made aware of the fact that the check is going to occur and provide the necessary information needed to carry out the background check.


Procedures

   1. Authorization
         1. All volunteers must authorize the NLYBS to conduct a background check.
         2. Failure to provide the authorization will preclude the volunteer from filling a position in which a background check is a requirement.
   2. Assessment
         1. The NLYBS Background Review Committee (BRC) will be responsible for assessing the information contained within the background check.
         2. Only convictions and pending convictions will be taken into account when reviewing a volunteers criminal history. An arrest without a conviction in a closed case will not be considered.
         3. Open criminal cases may preclude a volunteer from eligibility depending on the relevancy of the charge. The BRC is responsible for determining relevancy.
   3. Background Check Records
         1. To the extent possible, all information received in connection with the background check process will be treated as confidential.
         2. Information received in connection with the background check process is retained for up to 3 years.


Responsibilities

   1. The NLYBS Background Review Committee (BRC)
         1. Members ot the BRC are the 2 co-chairmen and the chief technologist.
         2. Provides the contracted third party with the information needed to perform the background checks.
         3. Charged with assessing all the information contained within the background check.
         4. Charged with protecting the volunteers privacy to the extent possible.
   2. Volunteers
         1. Provide the BRC with the information need to perform a background check.
         2. Provide the BRC with any information, if needed, to disambiguate the background check information.


Rights of the Volunteers

   1. To the extent possible, all information received in connection with the background check process will be treated as confidential.
   2. If you are denied a position based on negative information in the background report you can request a copy of that report.
   3. You have the right to dispute incomplete or inaccurate information.
   4. All disputes are to be referred to, and handled by the third party providing the background check.


Definitions

   1. Background Check
         1. A background check may contain, but is not limited to
               1. Criminal Records (County Criminal Felony & Misdemeanor, National Criminal Database, Federal Criminal)
               2. National Sexual Offender Registry Search


Disqualifications

   1. Convictions or pending convictions of the following offenses will disqualify the volunteers for any position
         1. Any sort of abuse or assault/battery — physical or sexual
         2. Rape
         3. Any crime of a sexual nature, including possession or dissemination of pornography
         4. Homicide or manslaughter in any degree
         5. Attempted murder
         6. Domestic violence
         7. Child neglect
         8. Felony drug crimes
         9. Animal cruelty
        10. Theft/robbery
        11. Forgery/fraud
        12. Kidnapping
        13. Arson
        14. Weapons violations
        15. Any crime, misdemeanor or felony, involving children as either an accomplice or victim
        16. Misdemeanor drug charges within last 15 years
        17. Multiple convictions for offenses (not listed above) of a similar nature.
        18. Any other crime, misdemeanor or felony specified by the NLYBS board
   2. Convictions or pending convictions of the following offenses will disqualify volunteers for any board position
         1. Any of the offenses listed above.
         2. Petty Theft.
         3. Any other crime, misdemeanor or felony specified by the NLYBS board
